THE BUSHCRAFT COMPANY TERMS & CONDITIONS OF BOOKING

Please read the below carefully:

1. AGREEMENT

Agreement on the basis these terms and conditions arise upon the fulfilment of all of the following: receipt by The Bushcraft Company Ltd of a properly completed booking form accompanied by the payment or deposit specified; clearance of the payment or deposit into The Bushcraft Company Ltd bank account; acceptance by The Bushcraft Company Ltd in writing.

The Bushcraft Company Ltd reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and The Bushcraft Company Ltd will return any payment accompanying the booking.

This agreement is between The Bushcraft Company Ltd and the client(s) and is the sole agreement between these two parties. No third party is a party to this agreement and shall not have any rights to enforce any term of it.

No variation of these terms and conditions shall be applicable unless agreed in writing by The Bushcraft Company Ltd at the time of booking.

2. BOOKING AND PAYMENT

Once you have discussed your requirements with our team, and subject to availability, we will hold your course dates once your booking form has been signed and the non-refundable holding fee has been paid. If the remaining 25% has not been paid within 6 weeks of the holding fee, we reserve the right to release your dates in the diary to other clients.

We will confirm that your course is reserved, and you will be sent a link to access the teacher portal which contains all information about the course.

PAYMENT STRUCTURE:

  • A booking in the current school year: The deposit will be a holding fee of £10 per head + VAT
  • OR A booking more than 12 months in advance: The deposit will be a holding fee of £250 + VAT
  • Remainder 25% interim payment is sent 8 months before the trip date
  • 25% interim payment is sent 6 months before the trip date
  • Final balance is sent 8 weeks before the trip date

If your trip is less than 8 months ahead, the remaining 25% deposit will be due within 6 weeks of paying the £10 per head deposit.
A payment plan that differs to that stated in the terms and conditions must be confirmed and authorised in writing with The Bushcraft Company.

LATE PAYMENT TERMS:
If invoices are overdue without notice, we reserve the right to cancel the trip and the cancelation policy applies.

If you have not paid in full by the travel date, we reserve the right to cancel the trip and retain all monies paid and the cancelation policies applies.

Staff places are free on a ratio for 1:10, excluding the need for 1-1 support for SEN students which are free in addition to the ratio of 1:10. Any additional teachers will be charged at a 10% rate of the per student price.

3. AMENDMENTS TO BOOKING

The Bushcraft Company Ltd appreciates that final numbers will not always be known at the time of booking, and will endeavour to accommodate amendments to bookings, but cannot guarantee that it will be possible.

The Bushcraft Company Ltd can only accept written requests (mail or email) for amendments, requests may be telephoned in initially but must be followed immediately by written confirmation.

Amendments to bookings which take the number of participants below the minimum course number of 30 will not be accepted.

For a major change, being any student number change greater than 10% of the originally booked student number, we reserve the right charge a fee as outlined below. If you have agreed a minimum number that is lower than the 10% decrease from your originally booked student number, this charge will not apply until you go below the stated minimum number. Your originally booked student number and minimum student number can be found on your booking form.

If you have agreed a course number with The Bushcraft Company Ltd with fewer than 30 participants then this will be regarded as the minimum course number and amendments to participant numbers below this will not be accepted. If a school wishes to proceed with a trip with less than 30 students The Bushcraft Company Ltd will charge for the minimum of 30 students. If the school does not want to pay the minimum of 30 students, then the cancelation policy applies.

With any number changes the occur within 8 weeks of the trip date, The Bushcraft Company Ltd reserves the right to charge the following fees.

*For every student drop below the agreed minimum number

  • Between booking and 8 months before the trip, we reserve the right charge £20 per participant decrease below the agreed minimum number to the school.
  • Between 8 and 4 months before the trip, we reserve the right to charge 25% per participant place.
  • Between 3 and 2 months before the trip, we reserve the right to charge 75% per participant place.
  • From 1 month before the trip to the date of travel, we reserve the right to charge 100% per participant place.

If you do not agree to pay the above fees, we reserve the right to cancel your trip and the cancelation policy applies.

4. CANCELLATION BY CLIENT(S)

If the booking is cancelled by the client(s) for any other reason, the following cancellation charges will arise:

  • The date holding fee is non-refundable at any time.
  • Cancellation between 8 and 3 months before the course: 25% total cost, payable to The Bushcraft Company Ltd.
  • Cancellation between 2 and 1 month before the course: 75% of total cost payable to The Bushcraft Company Ltd.
  • Cancellation less than 4 weeks before the course: 100% of total cost payable to The Bushcraft Company Ltd.

The client acknowledges that it is reasonable for such penalties to arise, given the need for The Bushcraft Company Ltd to make preparations for a course substantially in advance of the course.

5. PRICES

Whilst every effort is made to limit prices to those given in the booking, The Bushcraft Company Ltd reserves the right to alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials).

In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price.

In the event of the price being thus increased by 15% or more the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.

6. COURSE DATE CHANGES

Should a client wish to change the dates of their course, where there is a place available, an administration fee of £50.00 will be charged to transfer. If you wish to shorten the duration of your trip, the cancellation policy applies to the originally booked trip. Plus, any increase in cost for the chosen new dates.

7. VARIATION OF A COURSE BY THE BUSHCRAFT COMPANY LTD

The Bushcraft Company Ltd course is, by its very nature, exposed to natural variables, including the weather. Whilst every reasonable effort is made to deal with (indeed to learn from) such contingencies there may be occasions when The Bushcraft Company Ltd, through no fault of its own, is forced to vary or modify a course itinerary at short notice or decides to do so in order to take advantage of natural circumstances. The client acknowledges that information about courses provided by The Bushcraft Company Ltd is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for The Bushcraft Company Ltd to be liable for any losses consequential on such a change and that The Bushcraft Company Ltd liability is limited accordingly.

8. THE CONDUCT OF A COURSE

The client acknowledges that during The Bushcraft Company Ltd course he/she is required to submit to the reasonable instructions and leadership of The Bushcraft Company Ltd, save that parents, teachers and those in comparable roles in respect of children must maintain control of those children, to the satisfaction of The Bushcraft Company Ltd. The client acknowledges that persons attending a The Bushcraft Company Ltd courses are entitled to expect high standard of conduct and regard for personal wellbeing on the part of all clients.
For this reason the client accepts that The Bushcraft Company Ltd may, in absolute discretion and without the need to give reasons, arrange for him/her to be removed from a course, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; failure of control over children; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course. In such circumstances the client will not be entitled to a refund of monies and The Bushcraft Company Ltd will not be liable for any losses so resulting. The client will on demand reimburse The Bushcraft Company Ltd its reasonable costs of effecting his/her removal.

9. LIABILITY

The Bushcraft Company Ltd courses take place in the open countryside and are by their very nature not absolutely free from hazard. The Bushcraft Company Ltd makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without The Bushcraft Company Ltd being at fault and accepts that to that extent he/she is taking part in a course run by The Bushcraft Company Ltd at his/her own risk.

The Bushcraft Company Ltd only accepts liability for physical injury to a client that is shown to result from negligence on the part of The Bushcraft Company Ltd.

The client acknowledges that other loss, damage and expense (including without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and the harm caused other than by negligence of The Bushcraft Company Ltd) however arising is not the responsibility of The Bushcraft Company Ltd and The Bushcraft Company Ltd liability is hereby limited.

10. COMPLAINTS

In the unlikely event that a client has cause for complaint about a course run by The Bushcraft Company Ltd, complaint should be made to a representative of The Bushcraft Company Ltd during the event, in order that corrective action can, if necessary, be taken. The client acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved, complaint should be made in writing within 28 days.

To the extent permitted by law The Bushcraft Company Ltd will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course.

11. TRAVEL DOCUMENTS

The client is solely responsible, where necessary, for ensuring that he/she has all necessary valid travel documents and travel insurance.

12. CONSENT FORM

The Client is required to obtain the necessary parental consent for members to participate in our activities based upon the information we provide during the build-up to the trip. We expect the consent to include:

  • Acceptance of the level of risk associated with the type of activities they can expect to participate in (as provided in the Launch Pack to parents).
  • Consent for child to receive emergency medical treatment, including administration of an anaesthetic or blood transfusion, in the event of an emergency when parents cannot be contacted.
  • Consent for the establishment to share personal data such as contact details, medical and behavioural information with us (under the terms of the establishment’s privacy policy).
  • Acceptance of the price and payment terms.

13. SUBSEQUENT INSTRUCTIONS BY CLIENT(S)

Although, as stipulated above, all The Bushcraft Company Ltd courses are taught by highly experienced and capable leaders, it is not intended that any instruction provided to any client(s) while on a course will in any way qualify that/those client(s) to instruct any third party and no warranty is made to that effect. The Bushcraft Company Ltd hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any The Bushcraft Company Ltd course.

14. DATA PROTECTION

15. CONFIDENTIALITY AND NON-SOLICITATION

Unless required by law, neither party shall disclose the other’s Confidential Information to any person or entity. Neither party shall (except with the prior written consent of the other party) directly or indirectly solicit or entice away (or attempt to solicit or entice away) from the employment of the other party any person employed or engaged by such other party for a period of 12 months after the most recent course departure date, other than by means of a national advertising campaign open to all comers and not specifically targeted at any of the staff of the other party. Should a client solicit a member of The Bushcraft Company Ltd staff in this period, it reserves the right to charge a fee of either 50% of the individual’s annual remuneration or 50% of the total course fees for the calendar year prior to the member of staff’s departure from employment of The Bushcraft Company Ltd.

16. GOVERNING LAW AND JURISDICTION

This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation is governed exclusively by the law of England and Wales and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.

17. CHANGES TO THIS AGREEMENT

The Bushcraft Company Ltd reserves the right to update these terms and conditions at any time, without notice.
